First Offense Penalties:

  • Driver's license suspended for a term of 30 to 120 days
  • A fine in the amount of $200 to $500
  • Two to 30 days in jail (with up to four additional days if there are aggravating conditions)
  • 90 days in an alcohol or substance abuse program
  • 48 hours to 30 days of community service labor

Second Offense Penalties:

  • Driver's license suspended for a term of 12 to 18 months
  • A fine in the amount of $350 to $500
  • Seven days to six months in jail (with up to 14 extra days if there are aggravating conditions)
  • One year in an alcohol or substance abuse program
  • 10 days to six months of community service labor

Third Offense Penalties:

  • Driver's license suspended for a term of 24 to 36 months
  • A fine in the amount of $500 to $1,000
  • 30 days to 12 months in jail (with up to 60 extra days if there are aggravating conditions)
  • One year in an alcohol or substance abuse program
  • 10 days to 12 months of community service labor
